<p><strong>A:</strong> It&#8217;s <strong>Obamacare</strong>, silly.  Section 10907 of the Affordable Care Act imposes a 10% penalty on indoor tanning services offered by for-profits or non-profits. (You didn&#8217;t notice all the tanned bodies exiting the Salvation Army?)</p>
<p><strong><b>Q: </b>Did Rhode Island just raise or lower my taxes?</strong><br />
<em>–Poor in Pawtucket</em></p>
<p><strong>A: Yes it did</strong>.  If your household earns less than $30,000 annually and you are accustomed to the $300 &#8220;property-tax relief&#8221; check (also available to renters), <strong>fugget about it</strong> &#8212; unless you are 65 years old and/or disabled.  What? You didn&#8217;t read about it in the news? Maybe it&#8217;s cause it wasn&#8217;t there. <p>If you are a &#8220;C&#8221; corporation your tax rate <strong>has been cut</strong> from 9% to 7% effective January 1, 2015.  <strong>If your benefactor can wait until next year to die,</strong> the estate tax threshold has gone up from $921,655 to $1,500,000.</p>
<p><strong>Q: What&#8217;s an F-BAR? Is there a happy hour?</strong><br />

<p><strong>A: </strong>You mean the &#8220;Foreign Bank Account Report&#8221; and it will <em>not</em> make you happy. If you or your business have foreign bank holdings, the aggregate of which exceeded $10,000 <strong>at any point during the year </strong>you are required to disclose such assets by June 30 of the subsequent year or face a<strong> levy of up to 50% of the account&#8217;s value</strong>. <p><strong>A: </strong>Yes. The IRS recently unveiled the <strong>1023 EZ, </strong>a streamlined on-line application for organizations with under $50,000 in annual revenue. Typical applications have been taking upwards of a year to process. <div>Your tax return is due April 15, but taxes must be paid throughout the year, whether you are paid as an employee or are self-employed.  Otherwise you may be subject to underpayment penalties or public ridicule, whichever is the most uncomfortable. CPA&#8217;s are blessed with divine wisdom and hefty insurance policies.Self-employed individuals, investors  and others with substantial non-salary income are the most at-risk and should consider paying estimated taxes throughout the year.</div>

<p><strong><strong>I took out expensive student loans so I could earn a decent living.  Now that I am, my income is too high to deduct the interest. Why?</strong></strong></p>

<p>(Laughing). Nu, you thought the tax system was rational? The &#8220;phase-out&#8221; threshold for this deduction is extremely low; for example, if you are single and made more than $75,000, you&#8217;re out of luck.<strong>Meshugass! ( &#8220;craziness&#8221;).</strong></p>
<div><strong>Okay, what is phantom income? Do I need tickets to take it to  the opera?</strong></div>

<p>You are a partner in MSG for Yu.  You receive a &#8220;K-1&#8221; reporting $10,000 of taxable income because your ownership share made a profit, even though you did not receive $10,000 in cash. Or you own shares in Herbicides for All and the dividends are &#8220;reinvested&#8221;. The value of your investment has risen, but you don&#8217;t have any more money in the bank. Phantom  income can result in real taxes. Plan accordingly; don&#8217;t be a <strong>shlub</strong> (&#8220;fool&#8221;).</p>

<div><strong><strong>K-1? Isn&#8217;t that a brand of breakfast cereal?</strong></strong></div>
<p>Not yet! S-Corporations, Limited Liability Companies (LLC&#8217;s) and Partnerships are &#8220;pass-through entities&#8221;&#8211; they do not pay income taxes on their profit or deduct their losses.  Rather, the proportionate results are allocated to the owners via the IRS Form K-1 and reported on the individual tax returns of  these owners.</p>

<div>Dad owns Doughnuts with Holes and gives you a 10% share.  You are not  active in the  business. You receive a K-1 and it shows your share lost $8,000 (because doughnuts are Losers).  As a passive owner you <strong>cannot</strong> deduct those losses on your personal tax return unless they offset other passive income, or the business terminates.</div>
<p>Passive income is: your share of DDT Renewable, that Dad also gave you, made a profit &#8212; again, you are not active in the business but you<strong> must</strong> pay taxes on the income.  But you<strong>may</strong> deduct your Doughnut loss from your DDT gain.</p>

<div><strong>Oy vey tsu meina baina! (&#8220;Woe is me, down to my toes&#8221;).  I always pay taxes on my passive income but cannot necessarily deduct my passive losses?  That&#8217;s not fair.</strong></div>

<p><strong>Air Conditioner</strong> &#8212; if you are unlucky enough to suffer from allergies or other breathing impairments like asthma, you<strong> may</strong> be able to deduct this.</p>
<p><strong>Liposuction</strong> &#8212; Nope.</p>
<p>There is a common theme here &#8212; if a normally non-medical purchase or service is physician prescribed, you may be able to deduct it. If&nbsp; it is solely cosmetic and elective, not **.&nbsp; And of course there are odd ones that make it in, usually by a tax-court challenge.&nbsp; For instance,<strong> Navajo healing ceremonies</strong> do qualify.&nbsp; So book that trip to New Mexico.</p>
<p>And what may be considered a cosmetic procedure could qualify if it is deemed necessary for your business &#8212; do you have a <strong>nose job</strong> planned.? If you are a <strong>singer</strong> and your septum is screwing up your high notes, you might be in the range. <strong>&nbsp; Breast implants </strong>for exotic dancers have been allowed.</p>
